Insurance Companies & Accident Victims

Insurance Companies & Accident Victims

The person(s) responsible for a victim’s accident almost always has insurance coverage that will pay the accident victim’s personal injury claim.  The defendant’s insurance company hires a lawyer to represent him/her.

In these cases, the insurance company controls the litigation, including whether a settlement offer will be made and for how much.

Insurance companies have one objective – to minimize their payout.  As a result, they will be highly motivated to do whatever they can to pay nothing or to pay as little as possible, as every dollar they avoid paying, they get to keep.

The insurance carrier will argue that the accident was not their insured’s fault and will often blame the happening of the accident on the injured party.

The insurance carrier will strongly dispute the full nature of the victim’s injuries, including their pain and suffering.  They even sometimes will take the position that certain injuries were due to pre-existing conditions, and not as a direct result of the accident.

Our job is to prove to the insurance company that their insured is, in fact, liable for causing the accident.

We will have an investigator search for witnesses to the accident.  We often hire an Accident Reconstructionist or Engineer to support our client’s claim.

Our office will work with your doctors to assemble evidence of your injuries that is convincing and persuasive.  We will support your claim with reports from medical experts and diagnostic test results.

We will hire medical experts to testify to the severity and permanency of your injuries and the cost of your future medical care.  In addition, we will often hire Economists, Life Care Planners and Vocational Rehabilitation experts to quantify the amount of economic loss the accident has caused.

We speak to the insurance adjusters that handle Suffolk County cases on a daily basis.  This allows us to know what works and what does not work when it comes to settlement negotiations.

We are in the Riverhead courthouse almost every day and know most Suffolk County insurance company lawyers by their first name.  We have been litigating cases against them for over forty-five years.  By knowing how our adversaries will defend a case we are able to be to better prepare our client’s cases.

We will properly prepare your case and request a quick trial.

This will often push the insurance carrier into negotiating a settlement.  After the insurance carrier recognizes we are prepared and ready for a trial they often invite us to attend a mediation where our clients’ cases are often resolved for fair and adequate compensation without the risk of trial.

If the insurance carrier refuses to settle for a fair amount, we will seek to prove your case to a jury.

Our firm offers a free, no obligation consultation so that we can learn about your case, and so that we can then advise you as to your legal options for seeking recovery against those who may be responsible.
